Questioning leads to mistrial

Orlando Sentinel - A judge put an abrupt end to a death-penalty trial in Lake County, declaring a mistrial Thursday in the state's case against Dante Hall, one of twin Orlando brothers charged with a double homicide in Eustis. Lake Circuit Judge T. Michael Johnson sided with Hall's lawyers, Michael Graves and John Spivey, who argued that questions by Assistant State Attorney Bill Gross violated Hall's constitutional right against self-incrimination. Gross was quizzing Hall's girlfriend, Kim Jones, about a meeting with the prosecutor at the State Attorney's Office in Tavares in February 2007. She said Hall had accompanied her to the Lake County Judicial Complex because he had not yet been charged in the September 2006 killings of Kison Evans, 32, of Tavares and Anthony Bernard Blunt, 35, of Mount Dora. Gross then asked her if, at that meeting, he had extended an invitation to Hall to speak with him, too. Jones confirmed that the prosecutor had made the offer but that Hall had declined -- an answer that triggered the defense team's demand for a mistrial. The basis: Because of the defendant's Fifth Amendment right, the jury should not have known that Hall had a chance to talk and declined -- a fact that could be considered incriminating. "It was my mistake," Gross said. "I think the judge did the right thing." A new trial date has not been set for Hall, whose identical twin, Donte Hall, is scheduled to be tried Sept. 29 on the same charges. The brothers, 24, are accused of plotting a home invasion of a house party that left two men dead and two others critically injured nearly two years ago. Eustis police say the Halls hoped to take cash, jewelry and other valuables from men who hired Donte Hall's girlfriend and two other women to perform at the party. The trial started Tuesday with jury selection....

Orlando Sentinel - The mother of Kison Evans, one of two men slain by a spray of bullets inside a Eustis party house, wailed inconsolably Wednesday at testimony describing her son's death, prompting defense lawyers to seek a mistrial. Circuit Judge T. Michael Johnson halted proceedings, warned spectators and ordered jurors to disregard any emotional outbursts from the audience but overruled the objections of lawyers for Dante Hall, 23, of Orlando. Lawyers Michael Graves and John Spivey argued that the hysterics could prejudice jurors listening to the state's case against Hall, who could face death if convicted in the killings of Evans, 32, and Anthony Bernard Blunt, 35, of Mount Dora. Dante Hall and his identical twin, Donte Hall, are accused of orchestrating an armed home invasion of a party on Gottsche Street in Eustis where Donte Hall's girlfriend and two friends had been hired to entertain men. Assistant State Attorney Bill Gross told jurors he might not be able to show that Dante Hall fired bullets that killed Evans or Blunt or critically wounded Willie "Jay" Shelton or Joshua Daniels about 2 a.m. Sept. 9, 2006. But Dante Hall, his twin and two others share responsibility for the crime they helped plan, Gross said....
