Judges punished by state judiciary panel

Times-Union - One Greene County town justice quits post, another is admonished ALBANY -- One Greene County judge resigned and another was punished after separate actions by a state judiciary watchdog panel. Jewett Town Justice Rebecca McGowan resigned July 31 after allegations she gave special consideration to her brother-in-law and "failed to disqualify herself" in five other cases involving a friend or family member given special treatment.McGowan also failed in eight cases to deposit court funds within three days of receipt, as required by state law, the state Commission on Judicial Conduct said. The allegations against McGowan, who is not an attorney, were made last fall. In November, she admitted some were true, while denying others, the commission said. The case was resolved July 15 when McGowan resigned. She agreed to never seek or accept judicial office again, the commission said. The panel said McGowan gave special consideration to her brother-in-law, Charles Tatar, whose father, Stanley Tatar, had once been her fellow town justice. At Stanley Tatar's request, McGowan dismissed two charges against his son that alleged violations of the town's dog control law, the commission said. The commission also admonished Cairo Town Justice Thomas W. Baldwin. Baldwin, also not an attorney, was punished for "significant" delays in three small claims actions filed in his court, the panel said. In one case, Baldwin failed to render a decision after a hearing because of a lost file. Another time, he did not rule on a motion to dismiss a case. A third time, he didn't rule on a request to hold a debtor in contempt for the alleged failure to return a deposit of $855, the panel said. In another instance, the panel found, it was improper for Baldwin to delay issuing an eviction warrant. Baldwin resolved his case in July. Admonishment is the lowest of three penalties judges can face. The next highest penalty is censure, following by removal from the bench....
