http://www.axtora.com/homesites/us/utah/new-harmony/content/39268062d4dfbf4cf093527731871400.html CEDAR CITY Residents from the New Harmony area filled the Cedar City Council chambers Wednesday for a public hearing with the Utah Division of Water Rights concerning a pair of applications to change roughly 363 surface water rights to underground rightsTwo applications one by Mervin Prince for 318 acre feet and one by Orchard Flat Partnership for 45 acre feet involve farmland on the northwest end of the New Harmony area The applicants said their current irrigation system which includes pipelines from Pinto and Pace Creeks is deteriorating With underground rights they could pump water directly out of the groundThe current water is diverted into a pipe system running roughly two milessaid Roland Prince representing the applicants The pipes are old and are constantly losing water we're constantly having to repair them and we're losing a lot of waterHe added that a new housing development has affected their ditch systems which bring snow melt to the propertyWe figure by going to underground where we can use the water more ably it can serve a better purposePrince said water from the surface that the farmers would usually use would find its way back into the aquifer if their request is approvedWe're not trying to get more water we're just trying to use the water we've gothe saidThe proposed move worries some other New Harmony residents concerned about reports of lower water tables and the possibility of future threats to the health of the area's underground water aquifers Some have officially filed protests to the state officeBill Lane vice president of the Mountain Springs water company said he and the 392 shareholders he represents believe the state should not allow any more rights to the underground aquifer without first establishing accurately the basin's safe yield the amount of water than can be taken from the aquifers without drawing more than nature can replaceThe critical aspect of this is the safe yield of these aquifershe saidAquifers underground formations that hold water have been a hot topic in Southern Utah lately with talk in the EnterpriseBeryl basin of residents being capped on how much water they can draw The Cedar Valley basin has also experienced aquifer mining a term used to describe when more water is being drawn from the aquifer than snow melt rain and other sources can replaceWe're in trouble alreadyLane said And to exchange water rights at this point from surface to ground when they say all they have to do is fix the pipe and it's going to do the same thing I have to question thatCraig Smith an attorney representing some of the protestors raised questions about how reliable the surface water is and said he doubted it amounted to the full amount of water the applicants were requestingHistorically we don't believe that these sources have near enough water to fulfill the water right that's sought to be changedhe saidKent Jones assistant state engineer said there is a 30day review period following the hearing and the records on the issue would remain open At the end of that period the Division of Water Rights reviews the case at the regional level then at the state level before offering a decision A recordsetting drug bust Authorities unearth 80000 pot plants
